Acclaim Handling Ltd Training Terms and Conditions

1. General

These Terms and Conditions ("Agreement") govern the provision of Mechanical Handling Equipment (forklift trucks etc.) operator and associated training ("Training") by [Acclaim Handling Ltd] ("Provider") to the client ("Client"). By booking a suitable training course, the Client agrees to be bound by these Terms and Conditions.

2. Training Services

2.1 Acclaim Handling Ltd agrees to deliver Mechanical Handling Equipment and associated training in accordance with applicable industry (Acclaim Handling Ltd, Road Transport Industry Training Board – RTITB) standards and legislative requirements, including the Health and Safety Executives, Approved Code of Practice (L117).

2.2 When not within Acclaim Handling Ltd.’s accredited training centres, it is the Client’s responsibility to ensure that the equipment to be used, the training venue, and associated facilities are suitable and safe for training to take place.

2.3 With RTITB accredited instructor training courses there must be a minimum of two candidates per course for the training to proceed.

3. Equipment Suitability

3.1 The Materials Handling Equipment provided by Acclaim Handling Ltd and/or the Client for the training must be in good working condition, suitable for training purposes, and match the (ABA Workplace Transport Groupings) category of training booked.

3.2 Lifting Equipment (i.e. Forklift trucks) must have a valid Thorough Examination Certificate (under LOLER 1998 Regulations). A copy must be made available to the provider or their representative, prior to training commencement.

3.3 Acclaim Handling Ltd reserves the right to cancel or postpone any training courses, if the equipment supplied by the customer or via a third-party arrangement through the customer is deemed to be unsafe, non-compliant, or unsuitable. In such cases, the Client remains liable for the full cost of the booking made and any subsequent training courses booked.

4. Training Venue Requirements

4.1 The venue provided by the Client must be safe, legal, and appropriate for MHE or any other associated training activities.

4.2 It must include:

  • Sufficient indoor or outdoor training space free from hazards, where practicable, away from normal site activities.
  • Adequate lighting and weather protection (where applicable).
  • Access to toilets and other welfare facilities.
  • Suitable classroom facilities, with access to a TV or projector.

4.3 If a customer’s venue or a venue arranged by the customer is deemed unsuitable on the day of training, Acclaim Handling Ltd reserves the right to cancel the training session. No refund will be issued, and the full fee will be due.

5. Cancellation and Rescheduling

5.1 Cancellations must be made in writing. The following charges apply:

  • More than 14 days prior to commencement of training: No charge.
  • 14 days or less, prior to commencement of training: 100% of the fees due.

5.2 Requests to reschedule will be considered subject to availability and payment of any cancellation costs incurred.

5.3 Non-attendance without notice will result in the full fee being charged.

5.4 With a failed payment, Acclaim Handing Ltd reserves the right to cancel any training that may have been booked and/or charge reasonable administration costs/interest where settlement is unduly delayed. Note: Payment settlements include Invoice (purchase orders), credit card payments, direct debits.

5.5 All training dates are on a first-come, first-served basis and are provisionally allocated for 2 weeks. This is not confirmation of the course being booked or a slot being allocated for a candidate within a confirmed training course/date.

5.6 If a booking confirmation form (Form 15-003) is not received within 2 weeks of your original enquiry and/or when requested prior to the provisionally allocated training date, then the training dates may be allocated to another customer. No booking is confirmed without a booking confirmation form being completed and returned to us.

5.7 Acclaim Handling Ltd reserves the right to change the dates of any training course. Notification of any changes will be given to candidates or their representatives prior to the course start dates at the earliest opportunity.

6. Certification

6.1 Successful candidates will receive a training certificate valid for the period specified in the training package.

6.2 Acclaim Handling Ltd reserves the right to withhold certificates being issued until full payment for the training course is received.

6.3 It is the customers/candidate’s responsibility to supply relevant certificates as proof of previous training, where required. Failure to provide this information could result in the training being cancelled and full fees for the course being payable by the Client.

7. Liability

7.1 Acclaim Handling Ltd accepts no liability for injuries, damages, or losses arising from the use of Client-supplied equipment or facilities.

7.2 It is the Client’s responsibility to ensure adequate insurance coverage for its staff, equipment, and premises. Acclaim Handling Ltd will have suitable and sufficient insurance for its training personnel, and additionally for their own equipment and its sites.

8. Health & Safety

8.1 The Client must notify Acclaim Handling Ltd of any health and safety hazards or requirements on-site before the training commences.

8.2 All trainees must wear appropriate PPE (e.g., safety boots, hi-vis) as instructed.

8.3 All candidates must have a clear understanding of the English language, have good communication skills and be able to complete an English written exam and pre-shift inspection.

9. Force Majeure

9.1 Acclaim Handling Ltd shall not be liable for delays or failure to complete training due to causes beyond its reasonable control, including extreme weather, industrial action, or illness of attendees etc.

10. Health Acknowledgment

10.1 Customer Responsibility – Clients are expected to:

  • Inform candidates of relevant terms as described prior to attendance.
  • Ensure candidates arrive in good health and fit to train.
  • Comply with any on-site health and safety requests from our staff.

10.2 Candidates who arrive at our site displaying symptoms of a contagious illness may be refused entry or participation at the trainer’s discretion. This will be treated as a non-refundable cancellation.

10.3 Cancellations or non-attendance due to illness such as testing positive for COVID-19, or being required to isolate, will not entitle the customer to a refund or rescheduling. Full course fees remain payable.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

12. Changes to the Terms and Conditions.

We (Acclaim Handling Ltd) reserve the right to update these terms and conditions at any time and in response to government guidance, health risks, or operational needs.

Note: If the equipment to be used does not have a valid Thorough Examination, including completed further works with stated timescales, or Candidates are ineligible for the course due to lack of qualifying certificates provided before or on the day, then Acclaim Handling Ltd will not be held accountable, and the Client will still be charged.
